Perkara 122B Perlembagaan menyatakan dengan jelas siapa yang berhak melantik Ketua Hakim Negara, Presiden Mahkamah Rayuan, Hakim-Hakim Besar Malaya, Sabah dan Sarawak serta Hakim-Hakim Mahkamah Tinggi.

Perlembagaan mengatakan bahawa “Yang di-Pertuan Agong, bertindak atas nasihat Perdana Menteri, setelah berunding dengan Majlis Raja-Raja” akan melantik mereka.
